Terms of Service
These Terms govern business use of the Booqiva rental operations platform.
Version 2026-07-31
1. Contract and operator
These Terms form a contract between the customer accepting them and Capsule Technologies Ltd, registration number C108483, of Business House Suite 7, Triq l-arcisqof Pietru Pace, Victoria, Gozo, VCT 2504, Malta (“Booqiva”, “we”, “us”). They apply from 2026-07-31.
Booqiva is offered to businesses and authorised professional users. The person accepting confirms that they are at least 18 and authorised to bind the customer organisation.
2. Service and customer workspace
Booqiva provides hosted tools for bookings, inventory, locations, payments, documents, workforce, storefronts, partners and related rental operations. Features may evolve, provided changes do not materially remove paid core functionality without notice.
The customer controls its workspace data and is responsible for account invitations, roles, business configuration, prices, taxes, rental terms and the legality of its own services.
3. Accounts and security
Users must provide accurate information, protect credentials, enable required security controls and promptly report suspected compromise. Accounts may not be shared. The customer is responsible for authorised users and must remove access when no longer required.
4. Subscription, trial and payment
The subscription price shown on Booqiva business pricing pages is exclusive of VAT and other transaction taxes unless expressly stated otherwise. The applicable currency, plan, trial length, renewal date, tax and total payable are displayed before checkout. Subscriptions renew automatically until cancelled through the billing portal or support channel.
Stripe processes payment details. Booqiva does not store full card numbers. Failed or overdue payments may result in restricted access after reasonable notice. See the Subscription & Refund Policy.
5. Business customer and tax information
Booqiva is supplied on a business-to-business basis. The customer must provide an accurate legal name, billing address, country of establishment, company registration details and VAT or tax identification number where applicable, and must promptly update them.
Maltese customers are charged Maltese VAT at the applicable rate. A business established in another EU Member State may be invoiced under the reverse-charge mechanism only when the legal requirements are met and its VAT number is valid for intra-EU transactions. Supplies to businesses outside the EU are treated according to the applicable place-of-supply and evidence rules. If information is absent, invalid or inconsistent, Booqiva may charge VAT or withhold tax treatment until adequate evidence is provided.
6. Customer data and privacy
The customer retains ownership of customer content. The customer grants Booqiva the limited right to host, process, transmit and back up that content to provide, secure and support the service. Privacy roles and instructions are described in the Privacy Notice and Data Processing Agreement.
7. Acceptable use
The customer must comply with the Acceptable Use Policy, applicable laws, sanctions and third-party rights. Booqiva may suspend activity that creates an immediate security, legal or operational risk, using the narrowest practical restriction.
8. Third-party services
Optional integrations such as Stripe, Google Maps and email or storage providers are governed by their own terms. Availability may depend on those providers. The customer authorises Booqiva to exchange the minimum necessary data with integrations it enables.
9. Intellectual property and feedback
Booqiva and its licensors retain all rights in the platform, software, brand and documentation. No source-code, trademark or ownership rights are transferred. Feedback may be used without restriction, but Booqiva will not identify the contributor publicly without permission.
10. Availability, support and changes
We use commercially reasonable measures to keep the service available and secure. Planned maintenance, emergency work and events outside reasonable control may affect availability. Support channels and any service commitments are those shown in the applicable order or plan.
11. Confidentiality
Each party must protect non-public business, technical and customer information, use it only for the contract and disclose it only to personnel and providers who need it and are bound by appropriate duties. This does not cover information lawfully public, independently developed or lawfully received from another source.
12. Warranties and liability
Each party warrants it has authority to enter the contract. Except where law does not permit exclusion, the service is supplied on an “as available” basis and implied warranties are excluded. Neither party is liable for indirect or consequential loss, lost profits or lost business.
Subject to liability that cannot lawfully be limited, each party’s aggregate liability arising in a twelve-month period is limited to fees paid or payable by the customer for that period. This cap does not apply to fraud, wilful misconduct, confidentiality breaches, infringement obligations or payment duties.
13. Termination and data export
Either party may terminate for uncured material breach after reasonable written notice, or immediately for insolvency or unlawful use. Customers may cancel renewal through the billing portal. Before termination takes effect, customers should export needed data. Following termination, data is deleted or anonymised under the retention schedule and DPA, subject to legal preservation duties.
14. Governing law and notices
These Terms are governed by the laws of Malta, without prejudice to mandatory law that cannot be excluded. The courts of Malta have exclusive jurisdiction for business disputes, unless the parties agree another written process.
Legal notices to Booqiva may be sent to support@booqiva.com. We may notify customers through the account email, in-product notice or the registered workspace address.
